TERMS AND CONDITIONS

By submitting your order, you accept our Terms and Conditions, so please read carefully before doing so.

In the following Terms and Conditions, you, the customer shall hereby be referred to as “the customer”, “you” and “your”.  Easy Shop UK will be referred to as “Easy Shop UK”, “us”, “our” and “we”.  Items purchased by the customer will be referred to as “goods”.

1.Customer:

It will be your sole responsibility to:

  1. Give us a contact telephone number for correspondence during transportation and storage of goods.
  2. Should you require delivery to your address in Spain, you must ensure that somebody will be able to receive the goods.  We take no responsibility for goods once they have left with our Spanish carriage company.  In the event that there is no-one available to receive the goods, the carriage company will leave a note indicating the depot from which the goods can be collected. The collection of goods from said depot remains the responsibility of the customer.
  3. We require payment in full before we order goods from the UK shop and if delivery to your address in Spain is required, this too must be paid in full before your order is processed and sent by us to the UK shop.
  4. You must carefully check the Terms and Conditions of EACH shop website before placing your order with us.

2 Invoicing and fees

  1. Our fees, payable in euros, cover processing your order, handling costs, transport to Spain and storage at our Spanish warehouse.  Please note that goods may be stored for 1 week from the date of notification of arrival – thereafter, a fee will be incurred, payable on collection.  The fee will either be 2 euros a day or the equivalent of 5% of the Easy Shop shipping cost, whichever is the greater.  Should the fees reach 75% of the purchase value of the goods, they will automatically become the property of Easy Shop UK.  If you require your goods to be delivered to your address, an extra fee, charged at the local carriage rate must be paid when making the initial order.  If you later change your mind and wish to collect your goods from our Spanish warehouse, the local carriage charge will be refunded minus any bank charges, commissions etc.
  2. Payment can be made by bank transfer to our Spanish bank account, by Visa/Mastercard, Spanish debit card or cash payable in our shop.
  3. Our prices do not include additional insurance, custom duties or any other fees payable to government bodies (for insurance cover, see 6a).
  4. Exchange rate:  as this is continuously fluctuating, we will confirm our current rate of conversion when confirming your order.
  5. Goods which are larger than the standard Size 3 Box will be charged for according to size.

3 Advice and Information

Any oral advice given is without contractual liability.

4 Route and Method

Easy Shop UK reserves the right to choose the route and method for delivery, both from the UK to Spain and from our warehouse in Spain to your delivery address.

5 Home Delivery

The goods will be delivered within 2 to 5 working days from the time they arrive at our Spanish warehouse.  Please see 2a for conditions on receipt of goods.  Easy Shop UK will not be held liable for the loss or delay of any goods once they have left our Spanish warehouse.

6 Our Liability for Loss and Damage

Easy Shop UK will not be liable for indirect or consequential damage or the loss of profits whether or not resulting from the negligence of Easy Shop UK and employees thereof.

We will only be liable for loss or damage to goods whilst in our Spanish warehouse.  Whilst goods are in transit, they are covered by the Standard European Haulage Cover (Click here for their Haulage Terms and Conditions). This liability will be the same as the standard transport liability. 

Easy Shop UK will not be liable for any loss or damage arising from any act or omission of the customer or those for whom he contracts or of the servants or agents of either.

7 Haulage from the UK to Spain.

  1. Easy Shop UK uses an international haulage company to transport your goods from the UK to our warehouse in Spain.  This is done on your behalf and as such are subject to the Terms and Conditions set down by the haulage company.   2. We do not accept liability for goods confiscated, seized or removed by Customs Authorities or other government agencies.

8 Delays in Transit

Other than by reason of our negligence, we will not be liable for delays in transit, neither during the haulage of your goods from the UK to Spain nor from our warehouse in Spain to your delivery address.

9 Prohibited Goods

  1. Easy Shop UK will not be required or caused to transport any goods which are unlawful or deemed to be unsuitable.  We will not, without specific agreement, carry livestock, liquids, perishable goods, gases, pyrotechnics, arms, ammunition or corrosive, toxic, flammable, explosive, oxidizing or radioactive material.  We reserve the right to refuse the order and transport of any goods in the above list of items or any we deem to be unsuitable.  You will be notified of the removal of this item from your purchase order and the price adjusted accordingly before your order is processed.

10  Disputes

  1. Should a dispute arise from this agreement which cannot be resolved, either party may seek legal advice.  The goods will remain in storage at our Spanish warehouse until said dispute is resolved, without access or movement from the customer.
  2. Any disputes will be governed in accordance with and under the jurisdiction of the Spanish courts of law.

11 Privacy Policy

  1. To register with Easy Shop UK, you will be required to submit certain personal details, such as contact details, in order to process your order.  This information will be held on our computers.
  2. Details of any transactions entered into with us by you will remain on our computers for a period of 6 years in order to respond to any disputes which may arise in that period, with the exception of credit card details.  We will not keep on record any credit card details. 
  3. Easy Shop UK will keep other information about our customers if it is necessary for us to do so in order to comply with the law.
  4. Easy Shop UK endeavours to take all reasonable steps to protect your personal information.  We cannot guarantee the security of any data you disclose on-line.  You, the customer, must accept the security risks involved in providing information and dealing on-line over the Internet and will not hold Easy Shop UK responsible for any breach of security.

12 Returns Policy

  1. Easy Shop UK will not be liable for any goods which cannot be returned to the UK shop for any reason.  It is therefore the responsibility of the customer to always check the returns policy of each website/shop.
  2. Should you need to return any item, it will be governed by the Terms and Conditions of the original supplier (shop/website).  As our transport arrangement is by bulk to Spain, the cost to return any one item may be excessive.  At which point, the item could be posted back to the original supplier at your cost and if exchanged, a second haulage charge and any delivery within Spain would be charged to the customer.  Please contact us for help and advice should this situation arise.

13 General Haulage Terms and Conditions

  1. The Carrier is not a common Carrier and the Carrier reserves the right to refuse the carriage of any goods at its discretion and to inspect any Consignment
  2. The Carrier will not be liable for indirect or consequential damage or for the loss of profits whether or not resulting from the negligence of the Carrier.
  3. The Carrier will not be liable for any claims, costs and expenses by whomsoever made or incurred in excess of the limitations of liability stated within these Conditions, whether or not resulting from the negligence of the Carrier (except for claims in respect of death or personal injury resulting from the Carrier’s negligence).
  4. The Carrier will not be liable for any loss or damage arising from:

i. Any act of God including adverse weather conditions.

ii. Any consequence of war, invasion, act of foreign enemy, hostilities (whether war be declared or not), civil war, rebellion, insurrection, military or usurped power or confiscation, requisition, destruction of or damage to property or under the order of any governmental or public or local authority.

iii. Any seizure under legal process.

iv. Any act or omission of the Customer or those for whom he contracts or of the servants or agents of either.

v. Any inherent liability to wastage in bulk weight, latent defect or inherent defect or vice or natural deterioration of the goods.

vi. The inadequate or improper packing of the whole or part of the Consignment.

vii. The insufficient or incorrect labelling or addressing of the Consignment.

viii. Any riots, civil commotion, lockouts, general or partial stoppage or restraint of labour from whatever causes.

ix. Any marine risks.

x. Any delay caused by any reason beyond the Carrier’s control.

14.  Monetary Limit of Carrier’s Liability

  1. Subject to the Conditions set out above the liability of the Carrier in respect of any one Consignment shall be limited to the lower of:
  2. (i) An amount calculated (by reference to the gross weight of the Consignment and packaging as specified on the invoice and if no weight is so specified the actual gross weight of the Consignment and packaging) in accordance with the following formula:- 15,000 pounds per tonne.

    (ii) The cost value of the Consignment to the Customer.

    (iii) In the case of damaged goods the cost of repair of such goods.

  3. In the event that part only of a Consignment is lost, damaged or misdelivered, the liability of the Carrier shall be limited to the lower of that amount which bears the same proportion to the amount calculated in accordance with sub-clause 14a above as the actual value of the lost, damaged, misdelivered part of the Consignment bears to the actual value of the whole of the Consignment, or (ii) the cost of repair of any damaged part.
  4. In the event of any claim against the Carrier the Customer shall at the Carrier's request provide evidence of the cost and actual values of the Consignment (and the part of the Consignment in respect of which any claim is made).
